1. Acceptance and eligibility

You must be able to enter into a legally binding agreement to use the Services. The Services are intended for adults and businesses and are not directed to children. If you do not agree to these Terms, do not use the Services.

2. Accounts and security

You agree to provide accurate account and contact information and keep it current. You are responsible for protecting your sign-in credentials and for activity performed through your account. Tell us promptly if you believe an account has been accessed without authorization.

Business account administrators and authorized QwikVid team members may place or manage orders for other users connected to the appropriate customer account.

3. Orders, scheduling, and property access

Each order identifies the selected services, filming location, requested schedule, available add-ons, and customer-specific pricing known at checkout. An order is accepted when it is successfully recorded by QwikVid. Requested dates and arrival times may depend on service area, availability, property conditions, weather, and the scope of work.

You are responsible for providing complete and accurate property, access, scheduling, and contact information. You must have permission for QwikVid and its assigned photographers, videographers, or other team members to enter and capture media at the property. You are also responsible for notifying occupants and securing or identifying anything that should not be photographed or recorded.

Delivery dates and times are estimates unless QwikVid expressly agrees otherwise in writing. Changes to access, scope, weather-dependent services, or scheduling may affect completion and delivery.

4. Fees, payments, cancellations, and refunds

You agree to pay the prices, taxes, and authorized fees shown for an order. Customer pricing may vary by assigned rate chart, service area, property characteristics, selected options, and later approved changes. Card payments are processed by a third-party payment processor; QwikVid does not store full card numbers or card security codes.

Any cancellation, rescheduling, re-shoot, travel, rush-delivery, or refund terms presented with an order or otherwise agreed in writing are part of these Terms. If an order needs to change, contact QwikVid as soon as possible so we can explain the available options and any applicable charge before additional work is performed.

5. Customer content and permissions

You may provide listing details, logos, photos, videos, music, documents, instructions, and other material ("Customer Content"). You retain any rights you hold in Customer Content. You represent that you have the rights and permissions necessary for QwikVid to use it to provide the Services and that it does not violate another person's privacy, publicity, intellectual-property, or other rights.

You grant QwikVid a non-exclusive license to host, copy, process, edit, display, transmit, and otherwise use Customer Content as reasonably needed to fulfill orders, create and deliver media, operate selected property websites or tours, provide support, protect the Services, and comply with law. This license lasts only as long as reasonably necessary for those purposes, subject to legal and operational retention requirements.

Property websites, virtual tours, media links, and other publishing features selected by you may be accessible to the public or anyone with the link. Do not include confidential access instructions or other sensitive information in fields intended for public display.

6. Deliverables and intellectual property

Subject to full payment and any order-specific terms, QwikVid gives you a non-exclusive right to use the final deliverables supplied for the listing and marketing purposes for which they were ordered. Unless we agree otherwise in writing, this right does not transfer ownership of QwikVid software, templates, workflows, trademarks, pre-existing materials, raw or working files, or third-party content.

Music, fonts, stock material, platform features, and other third-party components may be governed by separate license terms. You may not remove ownership notices, resell standalone components, or use a deliverable in a way that exceeds an applicable third-party license.

7. Acceptable use

You may not use the Services to break the law, infringe rights, impersonate another person, transmit malicious code, disrupt or bypass security, probe systems without permission, send spam, or upload unlawful, deceptive, abusive, or harmful material.

You may not scrape, harvest, copy, or monitor the Services through automated means except through an interface QwikVid provides or with our prior written permission. You may not reverse engineer or attempt to obtain source code except where applicable law expressly permits it.

8. Third-party services and links

The Services may connect to payment processors, mapping and address tools, cloud hosting, media delivery, domain registration, social platforms, and other third-party services. Those services may have their own terms and privacy practices. QwikVid is not responsible for third-party sites or services that we do not control.

9. Disclaimers, limitation of liability, and indemnification

Except for any express written commitment, the Services are provided "as is" and "as available." To the fullest extent permitted by law, QwikVid disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted availability, a particular marketing result, sale, listing outcome, audience response, or business result.

To the fullest extent permitted by law, QwikVid will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from the Services. QwikVid's aggregate liability for a claim will not exceed the amount you paid QwikVid for the order or Service giving rise to that claim during the twelve months before the event. Some jurisdictions do not allow all of these limitations, so they apply only to the extent lawful.

You agree to defend and indemnify QwikVid from third-party claims, damages, and reasonable costs arising from Customer Content, your lack of required property or content permissions, your unlawful use of the Services, or your material violation of these Terms.

10. Suspension and termination

We may restrict or suspend access when reasonably necessary to protect customers, QwikVid, or the Services; investigate suspected misuse; address nonpayment; or comply with law. We may terminate an account for a material or repeated violation of these Terms. Provisions that by their nature should survive termination—including payment obligations, licenses needed to complete or retain existing work, ownership, disclaimers, liability limits, and indemnification—will survive.

11. Changes, governing law, and contact

We may update these Terms as the Services or law changes. We will post the revised Terms and update the date above. When legally required, we will provide additional notice. Continued use after an update becomes effective means you accept the revised Terms.

Except where applicable law requires otherwise, these Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, and disputes may be brought in courts with jurisdiction in Los Angeles County, California. If any provision is unenforceable, the remaining provisions remain in effect. These Terms and any order-specific written terms are the entire agreement concerning the Services they cover.
